The Model GST Law specifically treats a ´works contract´ (including any transfer of property in goods in the execution of such contract) as a ´service´. However, determining the nature of a particular agreement, or a set of agreements, for a project (i.e., whether it qualifies as a works contract or not) would still be critical from the perspective of the place of supply, the taxable value, the applicable rate of tax and the compliances to be undertaken given the peculiar and varied nature of arrangements in the infrastructure sector, involving multiple scopes of work and multiple participants (consortium) for either a full project or for parts of a single project.

Contractors in Kerala who failed to repair roads, that are damaged before the guarantee period, will be blacklisted, the Kerala government has said. Ports and Fisheries Minister K Babu asked contractors to repair the roads at the earliest. Media reports say that contractors are not enthusiastic to take up upgradation of roads planned at Rs 72 crore by the Bruhat Bengaluru Mahanagara Palike (BBMP). The work comprises upgradation of seven major roads, including Residency and Richmond Road in the heart of the Indian IT City. Although BBMP and Karnataka government are eager to provide quality roads in the city through 'TenderSure' initiative by integrating all the civic agencies, there are no takers for the project.
