High Court clears land acquisition for metro project

The transport department of the West Bengal government received clearance from the Calcutta High Court for the land acquired to implement a part of the
East-West Metro project.

The department acquired land for construction of Central Station at Bowbazar in the city under the metro rail project.

However, residents of the area opposed the land acquisition arguing that the state government failed to announce the award of compensation within the stipulated time period.

The residents filed a case against the acquisition in a trial court, which observed, in September 2012, that the consequences for non-publication of compensation award within the statutory period as provided in Section 11A of Land Acquisition Act, 1894, would follow in the case.

Therefore, the court passed an order that the entire land acquisition proceedings concerning the properties stood lapsed.

Later, the state’s Land and Land Revenue Department had moved the division bench of the Calcutta High Court against the order.

The High Court observed that the state proved that the award was announced within the statutory period of two years and not beyond that as claimed by the residents who had challenged the acquisition. Thus, the High Court set aside the trial court order.
